Shelby County Liquidation Attorney — Experienced, Compassionate, Reliable
Are you a casualty of the recession — jobless, behind on your mortgage or car payments, and constantly harassed by creditors?
Many of our fellow Tennesseans are in dire financial straits through no fault of their own. In today's fragile economy, an unexpected illness or injury, expensive divorce or sudden job loss can throw your world into chaos. You deserve the "fresh start" that Chapter 7 bankruptcy strategies can provide — laws enacted decades ago, to help deserving people just like you, with families just like yours.
Whether you have fallen on hard times because of economic conditions beyond your control or simply lived beyond your means, you can benefit from the experience and expertise of a lawyer who never judges you — a lawyer who genuinely wants to help.
I want to be that lawyer for you. I am attorney Ben Sissman. I have more than 30 years of experience helping clients file for Chapter 7 bankruptcy in Memphis, Shelby County and surrounding areas in Tennessee. If you are buried beneath a mountain of debt and are desperate for someone to trust, I can guide you to lasting debt relief — and show you how to avoid debt and credit problems in the future.
In Chapter 7 "liquidation" bankruptcy, all of your debt that can be legally eliminated, or "discharged," is completely wiped clean. In exchange, you have to sell all of your "non-exempt" assets and let your creditors share the proceeds. Most people who file for Chapter 7 bankruptcy don't actually own any non-exempt assets, so they don't end up having to sell anything. And property exemptions can help you to keep certain assets and possessions.
You have come too far to surrender your present and future to harassing creditors. You owe it to yourself and your loved ones to learn about your options in a free initial consultation. A Bankruptcy Lawyer Who Wants You to Know This: 'You're Going to Be Okay'
When a debt is discharged in Chapter 7, such as a credit card bill or medical debt, that means it has been forgiven, deleted, wiped clean. But not all debts can be discharged. Taxes, domestic obligations, personal loans and student loans are not considered dischargeable debt except under fairly extreme circumstances. Secured debt — debt that is "secured" by collateral, like a mortgage or car loan — cannot be discharged unless you give up the property that secures the loan.
Your home and your car may be exempt assets, up to a certain amount. This means you may not have to sell them in order to have your debt discharged in a Chapter 7 bankruptcy. If you are facing foreclosure, garnishment or repossession, you can use Chapter 7 or Chapter 13 reorganization bankruptcy to stop those actions, which gives you time to catch up on back payments. The "automatic stay" feature of consumer bankruptcy stops creditor harassment too.
As your Memphis Chapter 7 bankruptcy attorney, I arm you with the facts you need — facts that can lead to sound decisions about your future and a rewarding life after bankruptcy. Learn more about Chapter 7 bankruptcy during a free initial consultation at my law office.
