Ben Sissman Protects Your Paycheck, Your Car or Truck — and Your Rights
If your car has been repossessed, you can get it back by filing a Chapter 13 bankruptcy so long as the vehicle hasn't already been resold. A Chapter 13 strategy allows you to restructure your payment plan to make it more manageable. The moment you file for bankruptcy, the judge issues an "automatic stay" that forbids your creditors from making any further attempts at collections, including repossession.
Chapter 13 bankruptcy can also help you put a stop to wage garnishment. If you don't want to file for bankruptcy, you can also file a "Motion To Set Payments" with the bankruptcy court. The court will give an order setting a new payment plan that you can handle. As long as you make the new payment, the creditor can't garnish your wage.
However, the creditor has the right to contest this motion, so you should have an experienced lawyer to represent you.
As your Memphis garnishment attorney, I arm you with the facts and options you need to know — information and guidance that can lead to sound decisions about your future. I always welcome the opportunity to address your questions and concerns throughout the legal process. The first thing I tell my clients is this: "You are going to be okay."
I look forward to speaking with you at this toll-free number: 866-788-0394.
