How Bankruptcy Can Stop Foreclosure

Foreclosure, Bankruptcy and the "Automatic Stay"

When you file for Chapter 7 or Chapter 13 bankruptcy, the judge immediately issues an automatic stay, which is an order telling all of your creditors to halt their efforts at collections. This includes the bank's effort to foreclose on your house. When the foreclosure action has been halted, you can do whatever needs to be done to catch up on your mortgage payments.

Understand, you cannot discharge your mortgage debt. You will have to pay for the house so long as you continue to own it. But you can discharge other debts and restructure your payment plans, allowing you to catch up on your back payments. If you can't afford your mortgage payments even after restructuring your other debts, you may have to think about moving into a new house or apartment.
