Bankruptcy and Repossession
If your car has been repossessed, you can get it back by filing a Chapter 13 bankruptcy so long as it hasn't already been resold. Chapter 13 bankruptcy will allow you to restructure your payment plan to make it more manageable. The moment you file for bankruptcy, the judge issues an "automatic stay" which forbids your creditors from making any further attempts at collections, including repossession.
Stopping Wage Garnishments
Chapter 13 bankruptcy can also help you put a stop to wage garnishment. If you don't want to file for bankruptcy, you can also file a "Motion To Set Payments" with the bankruptcy court. The court will give an order setting a new payment plan that you can handle. As long as you make the new payment, the creditor can't garnish your wage. However, the creditor has the right to contest this motion, so you should have an attorney to represent you.
