The Lawsuit Against You May Not Have Merit

I have handled many cases where creditors attempted to collect on debts when they had absolutely no right to do so. Some creditors try to collect on debts that have expired. Some creditors try to collect on debts they don't even own. In most cases, they get away with this because debtors tend not to hire lawyers and raise the right objections.

Some debtors would only have to show up in court to prove they don't owe the debt. But since they think it's a lost cause, they don't, and they end up having to pay.

How Bankruptcy Can Help

If you can't pay a debt like a credit card bill and you don't want to face a lawsuit, then your other option is to file for Chapter 7 or Chapter 13 bankruptcy. Once you file for bankruptcy, the judge will issue an "automatic stay," which orders your creditors to immediately stop all of their efforts at collections.
